Privacy policy

Div 0 Corporation Pty Ltd (ACN pending) trading as CGT Valuer (we, us, our) is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Who we are

This policy is issued by Div 0 Corporation Pty Ltd (ABN to be issued), trading as CGT Valuer (CGT Valuer, we, us, our). We operate the website at cgtvaluer.com and a referral and workflow service connecting Australian asset owners and advisers with independent valuation professionals.

2. What information we collect

We collect personal information that is reasonably necessary to provide our services, including:

  • Identity and contact details (name, email, phone, postcode, role).
  • Information about the asset you want valued (business or property), such as industry, location, approximate value, ownership structure and intended use of the valuation.
  • Communications with us and with valuation providers introduced through the platform.
  • Account, authentication and security information if you create a login.
  • Technical information such as IP address, device, browser, referrer and pages visited, collected via cookies and analytics tools.

We do not intentionally collect sensitive information (as defined in the Privacy Act). Please do not submit health, racial, political, religious or other sensitive information through our forms.

3. How we collect it

We collect personal information directly from you when you submit a valuation enquiry, contact us, subscribe to updates, create an account, or correspond with us. We may also collect information from your device automatically (cookies, analytics) and, where relevant, from third parties you have authorised (e.g. an accountant referring you to us).

4. Why we collect, hold, use and disclose it

We use personal information to:

  • Match your enquiry with one or more suitable independent valuation providers.
  • Facilitate communication between you and those providers.
  • Operate, secure, improve and personalise the platform.
  • Send you transactional messages and, with your consent, marketing communications you can opt out of at any time.
  • Comply with our legal obligations and resolve disputes.

We disclose limited personal information to the valuation provider(s) we introduce you to, to our hosting, email, analytics and customer-support service providers (some of whom may be located overseas, including the United States and the European Union), and to regulators, courts or law enforcement where required by law.

We do not sell your personal information.

5. Direct marketing

We may send you marketing communications about CGT Valuer where you have consented or where permitted under the Spam Act 2003 (Cth). Every marketing email contains an unsubscribe link. You can also opt out at any time by emailing privacy@cgtvaluer.com.

6. Cookies and analytics

We use cookies and similar technologies to operate the site, remember preferences, measure usage and improve performance. You can control cookies through your browser settings. Disabling cookies may affect site functionality.

7. How we store and secure information

We hold personal information in secure cloud infrastructure provided by reputable suppliers. We use reasonable technical and organisational measures including access controls, encryption in transit, logging and regular review. No system is perfectly secure; if we become aware of an eligible data breach we will respond in accordance with the Notifiable Data Breaches scheme.

8. Overseas disclosure

Some of our service providers (e.g. hosting, email delivery, analytics, AI) store or process data outside Australia. By using the platform you acknowledge that your information may be disclosed to recipients located overseas, including in the United States and the European Union. We take reasonable steps to ensure overseas recipients handle personal information consistently with the APPs.

9. Accessing and correcting your information

You can request access to, or correction of, the personal information we hold about you by emailing privacy@cgtvaluer.com. We will respond within a reasonable period (usually 30 days) and may need to verify your identity first. There is no fee to make a request, though a reasonable cost-recovery fee may apply for access in certain circumstances.

10. Retention and deletion

We retain personal information only as long as necessary for the purposes set out above or as required by law. You can request deletion by emailing privacy@cgtvaluer.com; some information may need to be retained for legal, tax, fraud-prevention or dispute-resolution purposes.

11. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact privacy@cgtvaluer.com with the details. We will acknowledge your complaint and aim to resolve it within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.

12. Children

The platform is not intended for individuals under 18. We do not knowingly collect personal information from children.

13. Changes to this policy

We may update this policy from time to time. The current version is always available at cgtvaluer.com/privacy with the "last updated" date above. Material changes will be notified by reasonable means.
